Summary (not a substitute for the terms below):

  • These terms cover visits to the myphoneflow.com website only. If your organization uses the PhoneFlow product, its customer agreement governs that use instead.
  • The voice demo on the site is an AI assistant. Demo conversations may be recorded and transcribed, so please don't share sensitive information.
  • Information you send through our forms is handled under the PhoneFlow Privacy Notice.
  • The website is provided as is, and our liability to you is limited to $100.
  • Michigan law applies, and disputes go to courts in Michigan. If you or your organization have accepted our customer agreement or User Terms, their dispute terms apply instead.

IMPORTANT: THESE TERMS INCLUDE A DISCLAIMER OF WARRANTIES (SECTION 7), A LIMITATION OF LIABILITY (SECTION 8) AND A JURY TRIAL WAIVER (SECTION 9).

1. About these terms #

1.1 Who we are and what is covered #

The website at https://myphoneflow.com and its pages (the "Website"), including its voice demo and forms, is operated by Electric Software LLC, a Michigan limited liability company, doing business as PhoneFlow ("PhoneFlow", "we", "us").

By using the Website, you agree to these Website Terms of Use. If you do not agree, please do not use the Website.

1.2 The product is governed by a separate agreement #

These terms do not govern the PhoneFlow product, including the app at https://app.myphoneflow.com, phone numbers, AI agents, the web widget that businesses place on their own websites, and any trial. The product is governed only by the PhoneFlow Master Customer Agreement (https://myphoneflow.com/legal/customer-agreement/) and the documents it includes (the "Agreement"), which a customer accepts separately, and for individual product users, by the PhoneFlow User Terms (https://myphoneflow.com/legal/user-terms/).

Nothing in these terms changes the Agreement. Any acceptance of the Agreement, whether in the app or by a signed Order Form, is governed by the Agreement, including its dispute-resolution section, and not by these terms.

1.3 Who may use the Website #

The Website is for business visitors who are at least 18 years old. It is not directed to children. Children under 13 must not use the voice demo or submit any information.

2. The voice demo #

2.1 What it is and how it is recorded #

The Website may offer a voice demo. When you use it, you are talking with an AI assistant. Demo conversations may be recorded and transcribed, and are processed by our service providers, including AI providers, so the assistant can respond to you.

By starting the demo, you agree to that recording and processing, as described here and in the PhoneFlow Privacy Notice (https://myphoneflow.com/legal/privacy/). If you do not agree, do not start the demo; you can email [email protected] instead.

Demo conversations, and any contact details you give during a demo, are handled as described in the Privacy Notice.

2.2 Don't share sensitive information #

Do not give the demo health information, payment card numbers, Social Security or other government ID numbers, bank account details, passwords or other sensitive information.

2.3 Demo answers are not promises #

The demo shows how PhoneFlow works. Its answers may be wrong or incomplete. They are not an offer, a quote, a promise about the product, or legal, tax or other professional advice.

2.4 No emergencies #

THE VOICE DEMO IS NOT AN EMERGENCY SERVICE. IT CANNOT CALL 911 OR SEND HELP. IN AN EMERGENCY, CALL 911.

2.5 Fair use #

Do not use the demo to test its security, extract its instructions or settings, run automated or repeated sessions, record or impersonate anyone, or do anything unlawful. We may limit or end demo sessions at any time.

3. Forms and information you send us #

When you submit a form on the Website, such as a request for a free trial or a demo, your information is handled as described in the PhoneFlow Privacy Notice (https://myphoneflow.com/legal/privacy/). Our forms run on HubSpot, which processes that information for us.

  • Give accurate information, and submit information about someone else, or for an organization, only if you are allowed to.
  • We send marketing only as described in the Privacy Notice, and we call or text you for marketing only with the consent the law requires. You can unsubscribe from marketing emails at any time.
  • Submitting a form does not by itself give you access to the product or make you a customer. Access requires acceptance of the Agreement.

4. Our content #

4.1 Ownership and your permission #

PhoneFlow and its licensors own the Website and its content, including text, graphics, video, audio, the demo, software, and the PhoneFlow name and logo. You may view the Website and download or print pages to evaluate PhoneFlow for your business. No other rights are granted.

4.2 What you must not do #

You must not:

  • copy, republish or sell the Website or its content, or use it to build a competing product;
  • scrape or harvest the Website, other than standard search-engine indexing;
  • reverse-engineer or copy the demo or any code on the Website;
  • probe, scan, test or disrupt the Website's security or operation;
  • frame or mirror the Website, or suggest that we endorse you; or
  • use the Website unlawfully or in a way that infringes anyone's rights.

If you send us ideas or feedback, we may use them without any obligation to you. If you believe content on the Website infringes your copyright, email [email protected] with enough detail for us to find the content and understand your claim.

Product descriptions, prices, articles and other material on the Website are general information. They may change without notice and may be incomplete or out of date. They are not a warranty or an offer. Only the Agreement and any signed Order Form set the terms of the product.

The Website may link to sites or services we do not run, such as HubSpot or our customers' websites. We are not responsible for them, and their own terms and privacy policies apply.

6. Your responsibility #

If you intentionally misuse the Website (for example by attacking its security or scraping it), you are responsible for the resulting harm as the law provides.

7. No warranties #

THE WEBSITE, THE VOICE DEMO AND ALL WEBSITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, PHONEFLOW GIVES NO WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, AND DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. PHONEFLOW DOES NOT PROMISE THAT THE WEBSITE OR THE DEMO WILL BE AVAILABLE, ERROR-FREE, SECURE OR FREE OF HARMFUL CODE.

8. Limitation of liability #

TO THE FULLEST EXTENT THE LAW ALLOWS:

  • PHONEFLOW WILL NOT BE LIABLE FOR LOST PROFITS, LOST BUSINESS, LOST DATA, OR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES RELATING TO THESE TERMS, THE WEBSITE OR THE VOICE DEMO, EVEN IF WARNED THEY COULD OCCUR.
  • PHONEFLOW'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THESE TERMS, THE WEBSITE OR THE VOICE DEMO WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

THESE LIMITS APPLY UNDER ANY LEGAL THEORY. THEY DO NOT LIMIT LIABILITY THAT THE LAW DOES NOT ALLOW TO BE LIMITED.

9. Disputes #

  • Talk first. Before either of us sues about the Website, the one with the complaint will send the other a written description of it (to us at [email protected]), and we will both try in good faith to resolve it for 45 days.
  • Governing law. Michigan law governs these terms, without regard to its conflict-of-laws rules.
  • Courts. Any dispute relating to these terms or the Website will be decided exclusively by the state courts located in the State of Michigan or the U.S. District Court for the Western District of Michigan, and you and PhoneFlow consent to their jurisdiction. Either of us may still seek urgent relief in any court to protect intellectual property or stop misuse of the Website.
  • Time limit. Any claim relating to these terms or the Website must be brought within one year after it arises, or it is permanently barred.
  • Customers and product users. If you have accepted, or an organization you act for has accepted, the PhoneFlow Master Customer Agreement or the PhoneFlow User Terms, Sections 20 and 21 of the Master Customer Agreement govern every dispute between you (or that organization) and PhoneFlow, including disputes relating to the Website, the voice demo or anything published on the Website, and this Section 9 does not apply.

JURY TRIAL WAIVER: TO THE FULLEST EXTENT THE LAW ALLOWS, YOU AND PHONEFLOW EACH GIVE UP ANY RIGHT TO A JURY TRIAL IN ANY DISPUTE RELATING TO THESE TERMS OR THE WEBSITE.

10. Changes #

We may update these terms by posting a new version on this page with a new "Last updated" date. Changes apply only to your use of the Website after they are posted, and never to a dispute that arose before the change. Every version stays available at its own address (for example https://myphoneflow.com/legal/website-terms/v1.0/), and changes are listed at https://myphoneflow.com/legal/changes/. These updates cover the Website only; changes to the Agreement follow the notice process in the Agreement. No change to these terms affects any dispute-resolution provision of the Agreement or the User Terms.

We may also change, suspend or remove any part of the Website, including the demo, at any time.

11. General #

  • Ending access. We may block or limit your access to the Website if we reasonably believe you have broken these terms. Sections 4, 6, 7, 8, 9 and 11 continue to apply afterwards.
  • The rest. If a court finds part of these terms unenforceable, the rest stays in effect. Not enforcing a term is not a waiver. We may assign these terms to an affiliate or successor, including in a merger or sale of the business. These terms are the whole agreement between you and PhoneFlow about the Website. The Privacy Notice explains how we handle personal information and is not part of these terms.
